Terms of Service

Effective Date: August 13, 2026

Welcome to Rapid Roadside Rescue ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile roadside assistance services, website, online booking platform, and dispatch system (collectively, the "Services").

By requesting, booking, or accepting Services from us online, via phone, or in person, you ("Customer," "you," or "your") agree to be legally bound by these Terms. If you do not agree to these Terms, please do not request or accept our Services.

1.Description of Services

Rapid Roadside Rescue provides on-demand, mobile roadside assistance services throughout Syracuse, NY, and surrounding areas. Our services include:

  • Battery jump-starts and mobile boost assistance
  • Mobile EV charging and boost services
  • Tire assistance (spare tire installation, mobile tire service, and air inflation)
  • Vehicle lockout services
  • Emergency fuel and fluid delivery
Non-Towing Notice: Rapid Roadside Rescue is a specialized mobile roadside assistance provider. We do not provide vehicle towing or heavy vehicle transport services.

2.Service Requests, Location, and Access

  • Location Accuracy: You are responsible for providing an accurate GPS pin, address, or landmark location for your vehicle.
  • Authorization & Ownership: You represent and warrant that you are the registered owner of the vehicle or have express authority from the owner to authorize service on the vehicle.
  • Customer Presence: You (or an authorized adult representative aged 18+) must be present at the vehicle with valid photo identification and proof of vehicle authorization at the time of service, unless prior written arrangements have been made.
  • Safety Restrictions: Technicians reserve the right to decline or halt service if the vehicle is located in an unsafe or hazardous environment (e.g., active high-speed traffic lanes without proper roadside buffer, unsafe terrain, extreme weather hazards, or volatile situations).

3.Booking, Pricing, Cancellations, and Refunds

A. Pricing & Transparency

All service fees, call-out charges, and fuel/equipment fees are presented during online booking or communicated by dispatch prior to service execution. Quotes are estimates based on information provided by you; additional labor or specialty hardware fees may apply if the actual situation differs.

B. Payment Terms

Payment is due immediately upon booking or upon completion of service as dictated by the booking channel. We accept major credit cards, debit cards, and approved electronic payment methods through our secure digital payment processor.

C. Cancellation & Dispatch Fees

Dispatched Cancellation Fee: Once a service request is accepted and a technician is dispatched, you may cancel within 5 minutes at no charge. Cancellations made after 5 minutes of dispatch will incur a non-refundable $50 Dispatch Fee to cover travel and scheduling costs.

No-Show / Unreachable: If our technician arrives at the designated location and you are not present or reachable within 15 minutes, the service will be canceled, and the full dispatch/call-out fee will be charged to the payment method on file.

4.Pre-Existing Conditions and Limitation of Liability

A. Pre-Existing Damage

Rapid Roadside Rescue is not liable for pre-existing vehicle issues, including but not limited to: structural rust/corrosion, stripped or cross-threaded lug nuts/bolts, degraded battery cells, dry-rotted rubber, faulty electrical control modules, or pre-existing mechanical failures.

B. Service-Specific Disclaimers

Tire Services: Spare tire installation and mobile tire repair are temporary roadside measures. You are advised to have your wheel lug nuts re-torqued and tires inspected by a certified tire center within 50 miles of service.

Battery & EV Boost: Boost and charging services are intended to restore temporary power. We do not guarantee the underlying health of your vehicle's alternator, starter, or high-voltage battery system.

Damage Claims: Any claim of direct property damage caused by technician negligence must be reported to us in writing within 48 hours of the service call. Rapid Roadside Rescue reserves the right to inspect the vehicle prior to any third-party repair work.

C. Cap on Liability

To the fullest extent permitted by New York State law, Rapid Roadside Rescue's total aggregate liability for any claim arising out of or related to our Services shall not exceed the actual amount paid by you for the specific service call in question.

5.Indemnification

You agree to defend, indemnify, and hold harmless Rapid Roadside Rescue, its owners, operators, and employees from any claims, damages, losses, or legal fees arising from your breach of these Terms, misrepresentation of vehicle ownership, or hazardous conditions created at the service location.

6.Digital Booking & Privacy Policy

When you use our website or online booking platform, we collect relevant information (including name, contact details, vehicle information, and live location data) strictly to fulfill your roadside assistance request and process secure payments. We do not sell or rent your personal data to third parties.

7.Governing Law & Jurisdiction

These Terms are governed by and construed under the laws of the State of New York, without regard to its conflict of law principles. Any legal action, dispute, or proceeding arising out of or relating to these Terms or our Services shall be filed exclusively in the courts located in Onondaga County, New York.
